Debts and marriage

The same way, each spouse keeps their properties and belongings after the marriage, the debts do not demise to the other spouse. During the marriage, the other spouse is also not automatically liable for the debts of the other spouse, except for transactions concerning the daily life, § 1357 BGB.

Joint liability exists for example in cases of a credit agreement both spouses sign or if one spouse stands surety for the other.

However, if the spouses signed a marriage contract including a community of property, both spouses generate a joint estate, which is liable for the liabilities of both spouses.
