After a divorce or separation, the parents usually have joint custody for their common children.

Whoever has custody of the children has the right to make all decisions concerning the children, to decide with whom they live and with whom and where they can travel. That person can also decide in which city or country the children reside.

Generally, the law intends to grant joint custody to the parents, even after a divorce. The parents, however, can jointly decide to transfer the custody to only one parent.

To get sole custody in front of the court is becoming more and more difficult. Only if there are important reasons to believe that the welfare of the children is in danger, the court may decide to transfer the custody to only one parent.
